Terms & Conditions of sales (CGV)

Applies to all consumer (B2C) sales on nexusinstrumentgear.com.

Article 1 — Identity of the seller. Products are sold by [legal name][address], SIRET […], email […] (“the Seller”).

Article 2 — Scope. These Terms govern every order placed on the website by any customer (“the Customer”). Placing an order implies full acceptance of these Terms, which prevail over any other document.

Article 3 — Products. Products are described as accurately as possible. Photographs are non-contractual. Offers are valid while displayed and within the limits of available stock. Some items are sold on pre-order, with an indicative dispatch date shown on the product page.

Article 4 — Prices. Prices are shown in euros (€), inclusive of French VAT, excluding shipping costs which are indicated before order confirmation. The Seller may change prices at any time; the price applied is the one displayed at the time of the order. For deliveries outside the EU, customs duties and local taxes may apply and are the Customer’s responsibility.

Article 5 — Orders. The sale is final once the Customer has confirmed the order and payment, and the Seller has sent an order confirmation by email. The Seller may refuse or cancel any order in case of a dispute, non-payment, or manifest pricing error.

Article 6 — Payment. Accepted methods: [card, PayPal, …]. Payments are secured via [payment provider]. The order is processed after payment authorisation.

Article 7 — Delivery. See the Shipping Policy. Delivery times are indicative. Risk transfers to the Customer upon physical possession of the goods.

Article 8 — Right of withdrawal. In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has 14 days from receipt to withdraw without giving reasons. Article 9 — Legal guarantees. Independently of any commercial warranty, the Seller is bound by:

  • the legal guarantee of conformity (Art. L217-3 et seq. of the Consumer Code) — 2 years from delivery;
  • the guarantee against hidden defects (Art. 1641 et seq. of the Civil Code). The Customer may choose between repair or replacement, subject to the cost conditions of Art. L217-9. These guarantees apply regardless of any commercial warranty offered.

Article 11 — Age restriction (knives). Bladed products are sold only to buyers aged 18 or over. By ordering, the Customer certifies they are of legal age and that possession/carry of the product is lawful in their jurisdiction.

Article 12 — Liability. The Seller cannot be held liable for improper use of the products. Tools and knives must be used responsibly and in compliance with local law.

Article 13 — Personal data. Processing is described in the Privacy Policy (GDPR-compliant).

Article 14 — Consumer mediation. In accordance with Art. L612-1 of the Consumer Code, the Customer may, after a prior written complaint to the Seller, refer the dispute free of charge to the consumer mediator: [Mediator name, postal address, website].

Article 15 — Online Dispute Resolution. The European Commission provides an ODR platform: https://ec.europa.eu/consumers/odr.

Article 16 — Governing law. These Terms are governed by French law. In the absence of amicable resolution, disputes fall under the jurisdiction of the competent French courts, subject to the mandatory consumer-protection rules of the Customer’s country of residence in the EU.
