Article 1 — Identity of the seller
Products are sold by MS DISTRIBUTION, a SAS with share capital of €300.00, registered office at 214 rue du Général Leclerc, 95120 Ermont, France, registered under SIRET 823 146 964 00023, RCS Pontoise 823 146 964, intra-community VAT number FR63823146964, email contact@nexusinstrumentgear.com (“the Seller”), trading under the brand Nexus Instrument Gear.
Article 2 — Scope
These Terms govern every order placed on the website by any customer (“the Customer”). Placing an order implies full acceptance of these Terms, which prevail over any other document.
Article 3 — Products
Products are described as accurately as possible. Photographs are non-contractual. Offers are valid while displayed and within the limits of available stock. Some items are sold on pre-order, with an indicative dispatch date shown on the product page.
Article 4 — Prices
Prices are shown in euros (€), inclusive of French VAT, excluding shipping costs which are indicated before order confirmation. The Seller may change prices at any time; the price applied is the one displayed at the time of the order. For deliveries outside the EU, customs duties and local taxes may apply and are the Customer’s responsibility.
Article 5 — Orders
The sale is final once the Customer has confirmed the order and payment, and the Seller has sent an order confirmation by email. The Seller may refuse or cancel any order in case of a dispute, non-payment, or manifest pricing error.
Article 6 — Payment
Accepted payment methods: credit and debit card (Visa, Mastercard) and PayPal. Card payments are processed by Stripe via WooPayments; PayPal payments are processed by PayPal. The Seller never stores full card numbers. The order is processed after payment authorisation.
Article 7 — Delivery
Delivery times are indicative. Risk transfers to the Customer upon physical possession of the goods.
Orders may be dispatched in several separate parcels: titanium knives and tools are shipped from France, while printed apparel, stickers, mugs and patches are produced and shipped by our print partner from its own facilities. Items ordered together may therefore arrive on different dates and in different parcels. See the Shipping Policy for details.
Article 8 — Right of withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has 14 days from receipt to withdraw without giving reasons. The right of withdrawal applies to the Seller’s full catalogue. See the Returns & Refund Policy and the model withdrawal form.
Article 9 — Legal guarantees
Independently of any commercial warranty, the Seller is bound by:
- the legal guarantee of conformity (Art. L217-3 et seq. of the Consumer Code) — 2 years from delivery;
- the guarantee against hidden defects (Art. 1641 et seq. of the Civil Code).
The Customer may choose between repair or replacement, subject to the cost conditions of Art. L217-9. These guarantees apply regardless of any commercial warranty offered.
Article 10 — Commercial warranty (lifetime tool guarantee)
The Seller offers a lifetime guarantee against manufacturing defects on its titanium knives and tools (Clovis, T01 and subsequent models in the same range), for the lifetime of the product, to the original purchaser, on presentation of proof of purchase.
The guarantee covers, at the Seller’s discretion, repair or replacement of a product affected by a defect in materials or workmanship.
It does not cover: normal wear, blade sharpening and maintenance, cosmetic marks, corrosion caused by lack of care, loss or theft, damage resulting from misuse, abuse, accident, unauthorised modification or disassembly, nor use beyond the product’s intended purpose.
This commercial warranty does not apply to printed items (apparel, stickers, mugs, patches), which remain covered by the legal guarantees set out in Article 9.

Article 11 — Age restriction (knives)
Bladed products are sold only to buyers aged 18 or over. By ordering, the Customer certifies they are of legal age and that possession and carry of the product is lawful in their jurisdiction.
Article 12 — Liability
The Seller cannot be held liable for improper use of the products. Tools and knives must be used responsibly and in compliance with local law.
Article 13 — Personal data
Processing is described in the Privacy Policy (GDPR-compliant).
Article 14 — Consumer mediation
In accordance with Article L612-1 of the French Consumer Code, the Customer may, after a prior written complaint to the Seller, refer the dispute free of charge to a consumer mediator.

Article 15 — Governing law
These Terms are governed by French law. In the absence of amicable resolution, disputes fall under the jurisdiction of the competent French courts, subject to the mandatory consumer-protection rules of the Customer’s country of residence in the EU.
